Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of Grafix (the "Service"), operated by Tuncer Alçı, a sole proprietorship registered in Türkiye (tax ID 0500170524, Şişli, İstanbul). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. The Service
Grafix lets you submit a website URL to have its brand identity (logo, colors, fonts) analyzed, and uses AI to generate social-media-ready visual content based on that brand identity. You may only submit websites you own or are otherwise authorized to represent.
3. Accounts and Free Trial
You must provide accurate information to create an account and are responsible for keeping your login credentials secure. New accounts include a 7-day free trial. A valid payment method is required to start the trial, and your subscription will automatically begin and be charged once the trial ends unless you cancel before it does.
4. Subscription and Billing
Paid subscriptions are billed monthly or yearly in advance through our payment processor, Stripe. You can cancel your subscription at any time from your account's billing portal; cancellation takes effect at the end of the current billing period, and we do not provide partial refunds for unused time except where required by law.
5. Acceptable Use
You agree not to use the Service to generate or distribute unlawful, infringing, defamatory, or misleading content, to analyze or represent brands you have no right to represent, or to abuse, overload, or attempt to reverse-engineer the Service.
6. Intellectual Property
You retain ownership of the content you generate through the Service, subject to your compliance with these Terms and the rights of any underlying brand assets. Grafix and its underlying software, design, and technology remain our property.
7. AI-Generated Content
Content produced by the Service is generated using artificial intelligence and may occasionally be inaccurate, low-quality, or inadvertently similar to existing third-party material. You are responsible for reviewing all generated content before using or publishing it.
8. Third-Party Services
We rely on trusted third-party providers to operate the Service, including Supabase (hosting, authentication, and data storage), Stripe (payment processing), and OpenAI (AI content generation). Your use of the Service is also subject to the applicable terms of these providers.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.
10. Disclaimer and Limitation of Liability
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim.
11. Governing Law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts of İstanbul, Türkiye.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
